On 22 February, we noted that the Supreme Court had agreed to hear a challenge to the 10th District Court’s ruling on small refinery exemptions (SREs). In January, the Department of Justice, acting as counsel for the EPA, had requested that the Supreme Court not hear the case and instead affirm the 10th District case; the EPA announced it would be applying the ruling of the 10th District to all future SRE requests. Nonetheless, the Supreme Court announced it will hear the case on 27 April; the final decision could come around July.
