This follows two other cases dismissed last month, and not guilty verdicts by jury against five other defendants that constituted the agency’s third failed attempt to prosecute them. It is a miserable record. The agency said it is ending the latest cases “in an effort to conserve the resources of the Court, the parties, and the public.” The Biden Administration has made clear that it sees anticompetitive practices by agribusiness, and it is pursuing legal actions against the industry.
